Robert Williams v. NYCTA, et al. – Index No.: 509317/2024 – Kings County Supreme

Brief Factual Summary: Plaintiff alleged that he was an Access-a-Ride passenger in a motor vehicle operated by defendant Luisa Acosta Naranjo, when he was allegedly struck by a motor vehicle operated by Shani K. Clouden on Atlantic Avenue, at or near its intersection with Washington Avenue, Brooklyn, New York on January 30, 2023. Plaintiff alleged that defendant Naranjo was an employee of the NYCTA, through the Access-A-Ride program. On July 15, 2024, we filed a motion for summary judgment that the plaintiff was not an Access-A-Ride user on the date of the accident, that defendant Naranjo was not employed by the NYCTA nor did NYCTA own, maintain, or control the subject vehicles. On November 18, 2024, the motion was granted.
