Brief Factual Summary: Plaintiff alleged that on August 17, 2023, plaintiff was an Access-A-Ride passenger in a motor vehicle operated by defendant Joel Similien, when it allegedly struck a motor vehicle operated by Haroon A. Mirza on 3723 18th Avenue, Brooklyn, New York. Plaintiff alleged that defendant Similien was employed by the NYCTA. On February 28, 2025, we filed a motion for summary judgment that the plaintiff was not an Access-A-Ride user on the date of the accident, that defendant Similien and Mirza were not employed by NYCTA, nor did NYCTA own, maintain, or control the subject vehicles involved in this accident.
