Brief Factual Summary: Plaintiff alleged that on June 23, 2022, the plaintiff allegedly tripped and fell on a vent while walking on the sidewalk in front of 546 5th Avenue and West 45th Street, New York, New York. Plaintiff alleged that the vent/sidewalk was owned, operated and maintained by the NYCTA because it was near a NYCTA subway station. On January 10, 2025, we filed a summary judgment motion on the basis that the NYCTA did not own, operate or maintain the sidewalk/vent where the plaintiff allegedly tripped and fell on. A Stipulation of Discontinuance with prejudice against the NYCTA was filed.
