Senaida Zelaya- Lopez v. New York City Transit Authority – Index No.: 516845/2021 – Kings County Supreme

Brief Factual Summary: Plaintiff alleged she was rear-ended by a New York City Transit Authority work truck.  As a result of the incident plaintiff claims that she suffered injuries to her back, both shoulders, back and neck. A summary judgement motion was granted to plaintiff on liability, and the case proceeded to trial on damages. At trial we highlighted the testimony of our examining physician that plaintiff did not sustain any serious injuries and specifically did not sustain a significant limitation as a result of the accident. The jury agreed with our arguments and rendered a defendant’s verdict.
