Brief Factual Summary: Plaintiff alleged that on November 24, 2018, he tripped over a garbage bag with his left foot and his right foot stepped on a broken third step on the B staircase of the first floor/lobby floor adjacent to the back door of the building causing him to fall forward. As a result of the accident the plaintiff alleged injury to his left shoulder and right hand. During discovery we found medical records which confirmed the plaintiff was intoxicated at the time of the accident. Plaintiff demanded more than $1 Million, but the case settled for 215k.
